The Imperatives of Legislative Oversight on the Budgetary Process in Nigeria

Introduction

Legislative oversight refers to the actions and processes through which the legislature scrutinizes and evaluates the activities of the executive arm of government, especially in implementing policies and managing finances. This oversight is a constitutional responsibility under Section 88 of the 1999 Constitution of Nigeria, which empowers the National Assembly to investigate how public funds are utilized and expose cases of corruption or inefficiency.  In Nigeria, the budgetary process is a recurring activity that involves preparation, legislative approval, implementation, monitoring, and evaluation. The executive proposes the budget, which is then subjected to rigorous scrutiny, amendment, and approval by the legislature before implementation by relevant government agencies. Legislative oversight comes into play at various stages to ensure that the budget reflects national priorities and is implemented transparently and efficiently.  

 

The Importance of Legislative Oversight

Challenges Hindering Effective Oversight

Despite its importance, the practice of legislative oversight in Nigeria faces several challenges. Political interference is a major issue, as partisan interests can compromise the objectivity of oversight activities. Similarly, many legislators lack the technical expertise needed to thoroughly analyse complex budget documents and financial reports. Corruption further undermines the effectiveness of legislative oversight. Cases of lawmakers colluding with members of the executive to cover up budgetary irregularities are not uncommon, thereby weakening the integrity of the oversight process. Additionally, weak institutional frameworks and the absence of stringent penalties for breaches in budgetary processes make it difficult to enforce accountability.  

 

Enhancing Legislative Oversight

Strengthening legislative oversight requires proactive steps. Building the technical capacity of legislators and their staff is critical to improving their understanding of budgetary and fiscal processes. There is also a need to empower anti-corruption agencies and reinforce institutional frameworks to effectively address budgetary violations. Promoting transparency in the budgetary process is equally crucial. This can be achieved through the use of digital platforms to track budget implementation and ensure public accessibility to budget-related information. Legislators must prioritize national interest over personal or partisan considerations in their oversight activities. Finally, collaboration with civil society organizations can improve monitoring and foster greater accountability in the budgetary process.
