When someone is accused of a crime, it is not for them to go to court and prove their innocence. That person is entitled to sit back and require the case to be proved against them. This is because all of us are innocent until proven guilty. But why? Why don’t we ask people to prove they are innocent? There is not just one answer to this. There are lots of reasons why we all turn up at court as innocent people.
PROTECTING THE INNOCENT
“It is better to let ten guilty men go free than to convict one single innocent.” This quote from the famous lawyer William Blackstone shows how far the law will go to protect the innocent. Just imagine if you were convicted of a crime you did not commit. Imagine if you were sent to prison. Imagine what your family and friends would think of you. The law knows how wrong and scary convicting an innocent person is. So it says that we are all innocent before our guilt is proved.
RESPECTING THE PEOPLE
The government should protect our individual rights. The government exists for our benefit and our fundamental interests should be at the very heart of everything they do. We, of course, have a fundamental interest in not being told that we are criminals.
